It depends on the state and the country. Even if you can't sue for the transmission of the disease you may be able to sue for emotional trauma. Most states make it illegal to knowingly engage in sexual behavior and not notify the partner if you are HIV positive but for most STDs this isn't the case. You would have to sue them for damages.
That said, it's very hard to do because you have to prove that the person in question was the one that transmitted the disease to you and not a previous partner. Which as you can imagine in a court of law is almost impossible but it has been done.
These states specifically have no law regarding the knowing transmission of an STD:
Arizona Connecticut Delaware Hawaii Maine Massachusetts Nebraska New Hampshire New Mexico North Carolina Oregon West Virginia Wisconsin Wyoming
